Fort Wayne strip club owner Alva Butler is suing the city of Angola after he was denied a permit to open an adult business there last year.
Alva Butler's license request was denied back in November 2012 by Angola building commissioner Dean Twitchell. Butler was told that opening a gentleman's club did not comply with the city's ordinance.
The ordinance states that a sexually oriented business can not be within 750 feet of a residence. Attorney Scott Bergthold says there are at least five buildings that are within 750 feet of the proposed gentleman's club.
Butler says Angola city officials are limiting his free speech and due process rights by rejecting his permit. Now he is seeking monetary damages for lost profit.
The judge did not reach a decision Friday. A second hearing is scheduled for November 13th at 1:30 p.m. in South Bend.
