The judge in this ruling had some harsh words for Governor Mike Pence, saying the Governor had no power to enforce Indiana's gay marriage ban and then order executive agencies to do so following court rulings.
As a result, the judge named Pence as a defendant in the lawsuit.
Nancy Marcus, Indiana Tech Law School, says "So the court basically chastised Governor Pence in this court opinion, some very strong language saying that Governor Pence will be reinstated as a dependent. He should've been sued because he basically misrepresented is what the court is saying. His control over the marriage process in the state."
The judge's ruling on out of state marriages won't take effect until the 7th US Circuit Court of Appeals rules on the issues.
The 7th Circuit is scheduled to hear oral arguments next Tuesday/
